Holiday Club Membership Claim

Companies such as Club Class and Incentive Leisure began to offer memberships to consumers in the 90’s. These memberships claimed to offer hugely discounted five star accommodation, anywhere in the world for the remainder of the purchaser’s life, all for a small yearly membership fee.

Consumers who were tied into lengthy timeshare contracts would be targeted and told that they would be able to ‘trade in’ existing timeshares towards the memberships. Consumers would be tricked into attending sales meetings where they believed a buyer was present who wanted to take their timeshare ownership from them.

At these intense and lengthy sales meetings timeshare owners were told that they were being given a ‘one off’ opportunity to irrevocably relinquish their timeshares in part-payment towards the substantial cost of the Holiday membership.

During these meetings, often lasting up to six hours, consumers would be put under immense pressure to exchange their timeshare which they were told were essentially worthless, but they would be given a figure offset against the cost of the holiday club membership.

Consumers were scared into believing that the timeshare liability would continue in perpetuity and pass down to their heirs, it was sold on the belief that this holiday club membership would give them indefinite access to worldwide holidays without the worry of yearly maintenance.

In reality these companies would not take over the ownership over and just return them to the resorts who would in turn chase the consumer several months later for lost maintenance costs. Consumers would then find that they were liable for the maintenance fees on their old timeshare as well as the membership fee for the new holiday club.

If you have paid a company for a Holiday Club Membership and feel that you were coerced unfairly into purchasing the membership due to false promises and fraudulent incentives we can help you.

Here are some typical examples of misrepresentation and breach of contract by the companies providing holiday club memberships:

  • You were convinced that buying a holiday club membership is a better option than owning a timeshare.
  • You wouldn’t be responsible for any maintenance fees (unlike timeshare).
  • You would be able to book 5 star luxury accommodation and discounted flights all over the world with huge discounts.
  • Any money paid for the membership would be refunded via a cashback scheme redeemable after a set period.
  • You would be able to relinquish the membership whenever you wanted.
  • The company would buy and resell your membership and you would make a huge profit.
